1.1 This is an online privacy policy (“Privacy Policy”) of the Platform Budleaf – “budleaf-shop” served by the Company (Shyamsree Essentials Private Limited). We recognize the importance of privacy as well as the importance of maintaining the confidentiality of personal information. This Privacy Policy describes how We collect, store, use, handle and share or otherwise process your personal information (i.e., any information that identifies or can be used to identify, contact, or locate the person to whom such information pertains) through the Platform and its mobile application. The personal information collected and maintained by Budleaf shall be subject to this Privacy Policy (as amended from time to time). By accessing the Platform, You acknowledge and agree to be bound by the terms and conditions stated in the Privacy Policy.
1.2 Words not defined herein shall have the same meaning ascribed to it in the General Terms and Conditions.

2.1 The User visiting the Platform (Budleaf) does so at their own discretion and agrees to give their informed consent prior to registering with us. Your personal information (name, location, address, e-mail address, fax number, phone number, date and/or year of birth, debit/credit card information, user preferences etc.) will not be sold or rented by us to any third party without your consent. Though we reserve the right to communicate your personal information to any third party that makes a legally compliant request for its disclosure. We hold no responsibility for any action of a third party that may have directed You to our Platform.

3.1 Personal information includes your name, mailing address, phone number, email address, date of birth, credit card or debit card or other payment details, bank account number, financial information and any other details that may be requested by (Budleaf) from time to time is categorized under (“Personal Information”)
3.2 Information (viz. type of internet browser and operating system used, domain name of the portal from which you came, number of visits, average time spent on the site, pages viewed etc.) including information received from third parties and information collected through use of Budleaf’s Platform, cookies or other similar tools, may be picked up automatically and without being explicitly provided by You, but during your visit, usage and transaction on the Platform is categorized under (“Non-Personal Information”)
3.3 Personal and Non-Personal Information shall be collectively referred to as “Information”
- Collection of Information
4.1 We collect personal information to provide better experience and services to all our Users. We collect the following information from our Users:
4.1.1 We may collect personal information from You when you set up an account or transact, browse or use our Platform. We may also collect and store Content you create and Content you upload on our Platform;
4.1.2 We may collect information such as bank account numbers, billing and delivery information, credit/debit card numbers and expiration dates and tracking information from cheques or money orders to facilitate the sale and purchase of the product or services transacted on or procured through the Platform;
4.1.3 We may collect information about the browser, application and the device you use.
4.1.4 We track, record and retain your activities on the Platform, browsing patterns, buying behaviour, preferences, and other information that you choose to provide on our Platform. We use this information to do internal research on our Users’ demographics, interests, and behaviour to better understand, protect and serve our users. This information is compiled and analysed on an aggregated basis. This information may include the URL that you just came from (whether this URL is on our Platform or not), which URL you next go to (whether this URL is on our Platform or not), your computer browser information, clickstream patterns, internet domains, hostnames and your IP address. We may also collect the date and times that the Platform was accessed by You.
4.1.5 Depending on the device permission, We may also collect and process information about your actual location. We use various technologies to determine location, including IP address, GPS, Wi-Fi access points and mobile towers. Your location allows you to see User items near You.
- Use of Information
5.1 Once you provide information on the (Budleaf) Platform, You have deemed to authorise the Company to collect, retain, use and process the personal information for the following purposes (intended purposes):
(a) For verification of User identity;
(b) For processing the User’s registration process on the Platform and maintaining and managing the User registration.
(c) To assist Users in handling and fulfilling orders, enhancing User experience, collecting and receiving payments, inform You about offers, products, services and updates.
(d) For processing user transactions on the Platform.
(e) To customize and enhance your experience, detect and protect Us from errors, misuse, fraud and other criminal activity;
(f) To maintain and improve our services such as navigation on the Platform and carrying out transactions on the Platform.
(g) To provide information to the Seller or any third party who shall provide logistic service for delivery of products;
(h) For analytics and measurement to understand our Users;
(i) To check Your eligibility for certain products, issue a Goods and Service Tax invoice for the product and service purchase for your requirements, and provide you access to products or services being offered by the Sellers.
(j) For enabling payments and funds transfers with other banks/financial institutions;
(k) To diagnose problem(s) with our server and to administer our Platform;
(l) To provide notices, surveys, product alerts, communications and other marketing materials to User relating to the product or services;
(m) To enforce Our rights against You or any third party to establish, exercise or defend legal rights in connection with legal proceedings (including any prospective legal proceedings) and for seeking professional or legal advice in relation to such legal proceedings.
(n) For data analysis, research, development of new features, enhancement of User experience, identification of usage trends;
(o) For using cookies and beacons, tags and scripts to analyze trends, administer the Platform and track User movement around the Platform, including gathering demographic information about our User base;
(p) For making such disclosures as may be required under applicable laws, rules, regulations and guidelines or in respect of any investigations, claims or potential claims brought on or against us or against third parties
- Disclosure of Your Information
6.1 We may disclose Your Information internally to Our group companies, affiliates, related companies and with third parties for the purposes of providing products and services available on the Platform. These entities and affiliates may share such Information with their affiliates and other third parties for the purpose of providing You with their products and services and may market to You as a result of such sharing.
6.2 We may disclose your Information with third parties, including without limitation, banks, financial institutions, credit agencies, or Seller to enable such third parties to offer their products or services to such Users. While the Company shall endeavour to have in place an internal procedure to keep the information secure from intruders, there is no guarantee that such measures/procedures can eliminate all of the risks of theft, loss or misuse.
6.3 We may disclose your Information to any successor-in-interest of ours, such as a company that acquires us. In the event the Company goes through a business transition, such as a merger or acquisition by or with another company, or the sale of all or a portion of our assets, your Information will likely be among the assets transferred. 6.4 We may disclose your Information to third parties, such as Sellers or third-party service providers (including but not limited to data entry, database management, promotions, products and service alerts, delivery services, payment services, authentication and verification services and logistic services) (“Third Party Service Providers”) engaged by Us. These Third-Party Service Providers are under a duty of confidentiality to the Company and are only permitted to use such Information for purposes other than the ones specified in paragraph 5. However, we cannot guarantee that such Third Parties Service Providers will not disclose your Information. In no circumstance does the Company disclose data in relation to your personal identification numbers, passwords, bank account numbers, credit card numbers, expiry dates, CVV numbers, encryptions, cookies and other electronic details? We do not disclose your Personal Information to third parties for marketing and advertising purposes.
6.5 We may disclose your Information if required to do so by law or in good faith belief that such disclosure is reasonably necessary to respond to subpoenas, court orders or other legal process. 6.7 Any Information supplied by the User will be retained by the Company and be accessible to Our employees, and any service providers engaged by Us for or in relation to any of the purposes provided in paragraph 5.
6.8 Any and all voluntary Information uploaded by You on the Platform (including without limitation information about your products, images, remarks, feedback, etc.) may be made publicly available on the Platform and therefore accessible by any internet user. Therefore, the User should exercise caution when uploading any personal or proprietary information in voluntary information that the User submits or uploads on the Platform.
- Data Security, Retention and Disposal of Data
7.1 We shall endeavour to protect your Information in our custody. We shall take reasonable steps to ensure appropriate physical, technical and managerial safeguards are in place to protect your Information from unauthorized access, alteration, transmission and deletion. We shall ensure that the third parties who provide services to Us under appropriate contracts, take appropriate security measures to protect your Information in line with our policies. However, it may be clarified that no data transmission over the internet or any wireless network can be guaranteed to be perfectly secure. As a result, while the Company shall make best efforts to protect the information it holds, the Company may not be able to guarantee the security of any information that the User transmits to the Company and Users do so at their own risk.

We will only use your Information for those purposes and will make sure that your privacy is protected. We shall take reasonable steps to delete or permanently de-identify Information that is no longer needed.

- Modification
9.1 Any changes to this Privacy Policy will be communicated by us posting an amended and restated Privacy Policy on the Platform. Once posted on the Platform the new Privacy Policy will be effective immediately. Your continued use of the Platform shall be deemed to be your acceptance of the provisions of the Privacy Policy. User agrees that any information the Company holds about User (as described in this Privacy Policy and whether or not collected prior to or after the new Privacy Policy became effective) will be governed by the latest version of the Privacy Policy.

10.1 We provide all Users with the opportunity to opt out of receiving non-essential (promotional, marketing-related) communications from Us after setting up an account on the Platform. If you do not wish to receive promotional communications from us, then please unsubscribe by clicking on the unsubscribe link in the account settings. - Your Right
